RECOMMENDED that,
the lease of portions City Land, being a portions of erven 7000, 10565,10567 and 10568 Fish Hoek, situated off Central Circle, Fish Hoek, shown bordered grey and lettered ABCDEFGHJK on the attached Plan LT 1273V2 marked as annexure A, in extent approximately 4520 m², to Fish Hoek Tennis Club or its successors in title, be approved subject to inter alia the following conditions:

A tariff rental of R 966.09 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;

The lease will endure for a period of ten years with an option to renew for a further ten years;

The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;

The property be used for Sporting purposes only and for no other purposes whatsoever;

Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;

Subject to compliance with any other statutory requirements;

No compensation will be payable for any improvement made to the property.

Electricity services are known to exist within the vicinity and any alterations or deviation to electricity services necessary as a consequence of the proposal or requested by the applicant will be carried out at the applicant’s cost;

No Telkom services are known to exist within the lease area but it is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan;
-
Telkom requires access to carry out maintenance or upgrade existing plants at all times;
-
Adherence to the requirements of the City of Cape Town’s water by-laws;
l. A sewer (rising main) crosses the area in question (the approximate position is shown on the attached plan LT 1273v2) and no excavation or filling shall be carried out within the area without prior consent from Council;

The Council shall have the right of access at all times for the purposes of maintaining and repairing the sewer;
