It be NOTED that an application for a liquor licence received from THE WINE STORE.CO.ZA was considered in terms of sub delegated authority and that the following recommendation was forwarded to the Liquor Authority in terms of the Western Cape Liquor Act, 2008, as amended:
 
Subcouncil 03 recommends that the application for a Consumption Off (Internet Based Practice) Liquor Licence, reference no. LLA20090011, for the business The Wine Store.co.za be CONDITIONALLY SUPPORTED for the following reasons:

Supported with Conditions:

  1. That the licence contains a condition that only online sales are permitted and not physical sales from- or consumption on the premises.
  2. That the licence is granted on condition that there will be no alcohol stored on the premises at any time.

PARKING
It is stated in the application that three people will be employed to work at the premises. There is however no indication as to what impact this will have in terms of extra traffic and whether or not any arrangements have been made for parking. The property is situated on a corner and in a Close and any added vehicles may cause traffic obstructions in the street. The application must indicate how the staff will be accommodated in terms of transport.
 
REASONS FOR NOT SUPPORTING
In the application it is stated that "Trading hours sought during which it is proposed liquor may be sold or consumed on the licensed premises: 09:00 -18:00 Monday to Sunday". Although the applicant states in the motivation that alcohol will only be sold online, what is preventing him from selling alcohol from the premises once the application is approved. The trustees feel strongly that the application should be amended to make it clear that alcohol will only be sold online and not from the premises and that this should be made conditional to any approval.
The same applies to the statement that no alcohol will be stored on site, what is preventing the applicant from storing alcohol on site once the application is approved. It must be a condition of approval that no alcohol will be sold on site, stored on the premises, delivered to or collected from the premises.
 
TOWN PLANNING:
Supported with Condition:
The proposed application is supported subject to the following two conditions:
  1. Only 25 m2 of the existing dwelling is used by the proposed business.
  2. No alcohol or alcoholic beverages used by the online distribution business is stored and distributed from the subject property.
 
HEALTH:
Supported on Condition that the Business Licence is obtained and plans submitted to Building Development Management for approval.
