RECOMMENDED that,
 
 The lease of portions of City land, being portions of erven 4485, 3220 and 3221 Weltevreden Valley situated at Lillian Ngoyi Street,            shown bordered grey and lettered ABCDEFGH on the attached Plan LT 1353v1 marked annexure “A”, in extent approximately                       1220m², to Christian Centre Educare, or its successors in title, be approved subject to inter alia the following conditions:
 

  1. A tariff rental of R920 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable.  Rates not applicable;
  2. The lease will endure for a period of ten years with an option to renew for further ten years;
  3. The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
  4. The property shall be used for Educare centre purposes only and for no other reasons whatsoever;
  5. Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
  6. Subject to compliance with any other statutory requirements;
  7. No compensation will be payable for any improvement made to the property;
  8. The subject property is zoned Public Open Space 2 and as such does not permit an ECD Centre (day care centre/early childhood development centre).  In order to utilize the subject property for an Educare Centre the subject property would have to be rezoned from Open Space 2 to Community Zone 1;
  9. Submission of a building plan along with all other required land use applications that may be warranted for the approval by the land use management and building development sections in order to regularise the unauthorized ECD centre currently operating from the subject property is require;
  10. Electricity services are known to exist within the vicinity of the lease footprint and any alterations or deviation to electricity services necessary as a consequence of the proposal or requested by the applicant will be carried out at the applicant’s cost;
  11. Electricity infrastructure exists on the property or in its vicinity.  A wayleave shall be obtained from the Electricity Services Department before any excavation work may commence;
  12. Adhere to the City of Cape Town Health Department attached as Annexure “B”;
  13. No Telkom services are known to exist within the lease area but it is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan;
  14. Adherence to the requirements of the City of Cape Town water by-law attached as annexure “C”;
  15. The refuse generated on their premises must be stored on the premises to the satisfaction of the Director Solid Waste Management;
  16. The applicant must make use of all solid waste services and will be responsible for the clean-up of the area;
