Resolution detail

 
It is recommended that:

1.     In terms of Sections 14(2)(a) and 9B) of the Local Government: Municipal Finance Management Act 56 of 2003:

1. Council resolve that Erf 26259 situated at the corner of Thakudi and Maroela Streets, in Wallacedene, approximately 6 452m2 in extent, partially occupied, and zoned General Business 1, is not needed to provide the minimum level of basic municipal services, and

2. Council confirm that the fair market value of the asset described in (a)(i) and the economic and community value to be received in exchange for the asset described in (a)(i) have been considered;

2. In terms of Regulation 5(1)(b) of the Municipal Asset Transfer Regulations (MATR), R. 878 promulgated on22 August 2008, Council approve in principle the disposal of Erf 26259, Kraaifontein as described in (a)(i) above;
3. Any gain or loss incurred by the municipality in respect of the transfer of the asset described in 7(a)(i) be included in the adjustment budget of the municipality (section 28 and 87 of the Municipal Finance Management Act, Act 56 of 2003), if not budgeted for tin the approved annual budget.

4. That the application for the Proposed Granting of in-principle approval for the Transfer of erf 26259 situated at the corner of Thakudi and Maroela Streets in Wallacedence, Kraaifontein by way of a Public Competitive Process (call for alternative proposals) (LSU L4129) BE SUPPORTED on condition that the profit of this land be lessen in terms of the development levy.
5. Also, that funding of the erf be reinvested in sidewalks as upgrading of the total precing on site.
6. That Ald M Nieuwoudt will liaise with Ald J Vos in terms of the process of the sale.
