Recommended that the lease of portion of City owned Building, being a portion of Erf 1093, situated at Simon’s Town Hall, Cnr of St Georges Street and King George Way, Simon’s Town shown hatched and lettered ABCD on the attached plan marked annexure A, in extent approximately 112 m², to Andries Van Zyl, be approved subject to inter alia the following conditions, that:

A tariff rental of R920.00 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable. rental is effective and payable as from 01-07-2019;

The lease will endure for a period of ten years, with an option to renew for a further period of 10 years’ subject at any time to two months’ notice of termination.

The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;

The property be used for the purposes of toy museum (Cultural) only and no structures other than the existing structures will be permitted within the lease parameter;

Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;

Subject to compliance with any other statutory requirements;

No compensation will be payable for any improvement made to the property.

Electricity services may exist within the lease area and any alterations or deviations to electricity services necessary, as a consequence of the proposal or requested by the applicant will be carried out at the applicant’s cost;

A wayleave shall be obtained from the Electricity Services Department before any excavation work may commence. All excavation within 3m of the electrical services must be carried out under the direction of a representative of this Department. In this regard the Electricity Department must be contacted two weeks before commencement of work;

Telkom services are known to exist within the vicinity of lease area and it is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan;

No mechanical plant or vibrator may be used within 3m of any plant (i.e. any Telecommunication equipment above or below ground level);

Telkom requires access to carry out maintenance or upgrade existing plants at all times;

If any plant not indicated exists and information or supervision is required, Telkom must be contacted at least 48 hours before any work commence;
