That Subcouncil 10 SUPPORTS the proposed lease of City property, portion of erf 28836 adjacent erf 28837, situated at corner of Sicukujeje Crescent and Ntegu Street, Khayelitsha: Thozama Pre-School (025-831)
In light of the objections received during the public participation process against the proposed lease, it is recommended that these objections as set paragraph 6.1 of the report not be upheld and it be recommended that the lease of portion of City property, being erf 28836 adjacent to erf 28837, bounded by Sicukujeje Crescent and Ntegu Street, Khayelitsha, shown hatched and lettered ABCDE on the attached sketch ET 520 marked annexure A, in extent approximately 196 m2, to Thozama Pre-School (025-836 NPO), or its successors in title, be approved subject to inter alia the following conditions:
a) A tariff rental of R920 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;
b) The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
c) The lease will endure for a period of ten years, with an option to renew for a further ten years;
d) The property be used for social (pre-primary school) purposes only;
e) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
f) Subject to compliance with any other statutory requirements;
g) No compensation will be payable for any improvement made to the property.
