GRANTING OF IN-PRICIPLE APPROVAL: PROPOSED TRANSFER BY PUBLIC COMPETITION OF VACANT REMAINDER ERF 100326, 30 KATBERG STREET, HEIDEVELD, FOR A COMMUNITY FACILITY
 
Ms Davis informed the Subcouncil members that the purpose of the report to consider the proposed transfer by public competition of vacant remainder Erf 100326, 30 Katberg Street, Heideveld, for a community facility, property extent 1286 m².
 
Cllr Moses informed members that he supports the report with rider that;
 
  1. Reduced or discounted market related rates be implemented, i.e. consistency 25% of the property value discount
  2. The property be utilised for Community usage
  3. The department to be consistent when approving applications of similar nature.
 
RESOLVED
 
The Subcouncil members Supported the recommendation that:
a)Council resolve that, in terms of section 14 of the Local Government   Municipal Finance Management Act 56 of 2003, that the subject property, being remainder Erf 100326, situated at  30 Katberg Street, Heideveld, in extent approximately 1286 m² as shown lettered ABCDEF on Plan LIS 1525v0 (Annexure “A”), is not needed to provide the minimum level of basic municipal services and has considered the fair market value of the asset and the economic and community value to be received in exchange for the asset;
b)Council grants in-principle approval in terms of regulation 5(1)(b)(ii) of the Municipal Asset Transfer Regulations for the transfer of remainder Erf 100326, situated at 30 Katberg Street, Heideveld, in extent approximately 1286 m² as shown lettered ABCDEF on Plan LIS 1525v0 (Annexure “A”);
c)       It be confirmed that, when considering the alienation of the land at less than market value, as provided for in terms of Clause 15.3 of Council’s Policy on the Management of Certain of the City of Cape Town’s Immovable Property, the contents of Regulation 13(2) of the MATR has been duly taken into consideration.
 
d)       As part of the envisaged purpose, activities that will promote healthy and sustainable communities with specific focus on social cohesion programmes for example ECD, care for the elderly, etc., be included as a condition of approval.
