RESOLVED TO RECOMMEND
 
Subcouncil 20 supports the recommendation that the lease of portion of public street, being a portion of Erf 1418 Constantia, situated at Wycombe Avenue, Constantia, shown hatched and lettered ABCDEF on the attached Plan LT  1424v1 marked Annexure A, in extent approximately 250m², to Andrew Stuart-Reckling and Sarah Stuart-Reckling, owners of Erf 1435 Constantia, or their successors in title, be approved subject to inter alia the following Conditions:
 

  1. A tariff rental of R1566.09 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;
 
  1. The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
 
  1. The lease will endure for a period of ten years with an option to renew for a further period of ten years;
 
  1. The property be used for gardening and security purposes only;
 
  1. Any boundary fencing is to be of non-permanent, visually permeable (palisade fencing) type and will be subject to;
 
  1. The submission and approval of any necessary building plans in terms of the National Building Regulations if applicable;
 
  1. Any fencing that does not require the submission of plans in terms of the National Building Regulations will still require the approval of the Director: Property Management;
 
  1. No electricity services exist within the lease footprint but the following conditions will apply;
 
  1. Any alterations or deviations to electricity services necessary as a consequence of the proposal, or requested by the applicant, will be carried out at the applicant’s cost;
 
  1. Electrical infrastructure exists within the vicinity of the property. A way-leave shall be obtained from the Electricity Generation and Distribution Department before any excavation work may commence. In this regard contact the Electricity Drawing and Record Centre Office on telephone number 021 763 5650;
 
  1. No mature trees along Wycombe Avenue may be damaged or removed without the prior written permission from the Environmental and Heritage Management Department. The protection includes the root zone below ground and tree canopy above ground.;
 
  • All tree surgery to be done in consultation with the Area Head: Recreation and Parks;
 
 
  1. All manholes on the property are to be accessible at all times for maintenance and repair purposes;
 
  • Adherence to the requirements of the City of Cape Town’s Water By-Law;
 
  • Subject to such further Conditions to be imposed by the Director: Property Management in terms of her delegated authority;
 
  1. Subject to compliance with any other statutory requirements;
 
  1. No compensation will be payable for any improvement made to the property.
