That Subcouncil 18 SUPPORTS that the lease of portion of City Land, being a portion of Erf 68382 Cape Town, situated at Belper Road, Wynberg, shown hatched and lettered ABCDEF on the attached Plan LT1527v3 marked annexure A, in extent approximately 94m², to Abdul Fakier Richards and Balqis Richards, owners of Erf 91799 Cape Town or their successors in title, be approved subject to inter alia the following conditions, that:

A tariff rental of R522.61 per annum, excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;

The lease will endure for a period of ten years, with an option to renew for a further ten years;

The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;

The property be used for gardening and security purposes only;

Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;

Subject to compliance with any other statutory requirements;

No compensation will be payable for any improvement made to the property.

Should the lease be cancelled or required for a road or storm water purposes, the leased area may be required to be reinstated to the original natural state, to the satisfaction of City of Cape Town’s Transport Urban Development Authority Department.

A fire hydrant exists on the property. The fire hydrant and the area immediately around the fire hydrant must not be enclosed in order to allow for 24 hour emergency and maintenance access.

No electrical services exist on the property. Any alteration or deviation to electricity services necessary as a consequence of the proposal, or requested by the applicant, will be carried out at the applicant’s cost;

The applicant must comply with the National Building Regulation and by-laws relating to community fire safety, water and any other applicable legislation.
