RESOLVED TO RECOMMEND

That in terms of section 14(2)(a) and (b) of the Municipal Management Act (MFMA), Act 56 of 2003:

Council resolve that Erf 8343, situated at 20 Kanarie Street, Morningstar, Durbanville in extent approximately 296m2, zoned Single Residential 1, shown lettered ABCDE as reflected on Plan LIS 2032, not be required for the provision of the minimum level of basic municipal services;

Council confirm that the fair market value of the asset described in (a)(i) and the economic and community value to be received in exchange for the asset described in (a)(i) have been considered.

In terms of Regulation 5 (1)(b) of the Municipal Asset Transfer Regulations (MATR), R.878 promulgated on 22 August 2008, Council approve in principle the transfer of Erf 8343, Morningstar, Durbanville as described in (a)(i).

Erf 8343, Morningstar, Durbanville be transferred by way of public competition, subject to conditions to be imposed by the Director: Property Management in the exercise of her delegated authority
FURTHER RECOMMENDED

That due to the fact that this property was situated within a community where there was a need for housing, it BE CONSIDERED to have this property disposed of by public auction to provide residents the opportunity to participate in the process.

That the Subcouncil and Ward Councillor be informed of the process.
