PROPOSED LEASE OF PORTION OF CITY OWNED LAND, BEING PORTION OF ERVEN 11058 AND 11060 BELLVILLE AND UNREGISTERED STATE LAND, SITUATED AT BLANCKENBERG STREET, BELLVILLE CBD, BELLVILLE: UNIVERSITY OF THE WESTERN CAPE

Resolution detail

Subcouncil 6 recommended that the lease of portions of City land, being portions of Erven 11058 and 11060 Bellville and unregistered state land, situated at Blanckenberg Street, Bellville CBD, Bellville and as shown hatched and lettered ABCD on the Plan No TA 914v1 attached and marked Annexure A to the report, in extent approximately 101m², to the University of the Western Cape or its successor in title, be approved subject inter alia to the following conditions that:
  1. A market rental of R500.00 per month exclusive of VAT and inclusive of rates be payable;
  2. The lease will endure for a period of 10 years, subject to a review of the rental after a period 5 years;
  3. The monthly rental is to be adjusted on the basis of 8% per annum compounded annually on a pro rata basis commencing 6 months from the date of this valuation, ie 2018-09-30. Accordingly, the above recommended rental is to be adjusted as from 2019-04-01;
  4. The property be used for the purpose of constructing a canopy, outdoor seating and garden area to frame the entrance of the Bellville medical campus;
  5. Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
  6. Subject to compliance with any other statutory requirements;
  7. No compensation will be payable for any improvements made to the property;
  8. No structures may be erected on the property;
  9. No lease agreement will be concluded until such time that a valid Tax Certificate has been received from the applicant;
  10. A permit must be obtained to allow construction work within the road reserve;
  11. Any alteration to electricity services necessary as a consequence of the proposal, or requested by the applicant, will be carried out at the applicants cost;
  12. The throughfare may be enclosed on both sides and the erection of the gates must conform to the requirements and specifications and be carried out under the direct supervision of the staff of the City’s Electricity Department;
  13. The applicant may not remove any boundary wall or fence common to be lease area;
  14. No excavation is to take place on site without the possession of a wayleave and works permit;
  15. On termination of the lease, the entire leased area must be reinstated at the Lessee’s expense to a condition acceptable to the City;
  16. The following conditions are to be imposed on services crossing the land:
  • The City of Cape Town has the right to construct and/or erect and lay such poles, stays, cables, wires and appurtenances relating thereto as may be necessary, together with the right of use, inspect, maintain, repair, alter, relay and/or remove such poles stays, cables, wires or appurtenances aforesaid. This includes the right to bring machinery onto the property and to carry out excavations.
  • The City of Cape Town has the right for any employee or servant or contractor of the City of Cape Town to enter and be upon the property at any time in the exercise of the aforesaid rights.
  • No building, containers or structure may be erected within 1m of the electrical services.
  • No excavation or filling may carried out within 1m of any part of the electricity services or without the prior consent of the City and the City will be entitled to withhold such consent in its own discretion.
  • No material or plant may be stored within 1m of any part of the electricity services.
  • Any building or structure erected must comply with Regulation 15 of the Electricity Machinery Regulations of the Occupational Health and Safety Act No 85 of 1993.
