Wolfgat Subcouncil 12 RESOLVED to RECOMMEND that:
The lease of a portion of Erf 18256, situated at Hocheim Close, Mitchell's Plain, shown hatched and lettered ABCD on the attached plan LT 1365v2 marked Annexure A, in extent approximately 115 m 2 to Alvin James Dyers or his successors in title, be approved subject to inter alia the following conditions that:

A tariff rental of R835,65 per annum, plus VAT of 15%, being R125,35 (in total R961) subject to any increase in terms of rental for leased land as determined from time to time by Council. Rates if applicable;

The lease will endure for a period of ten years with an option to renew for a further ten years, subject at any time to TWO MONTHS notice of termination;

The land will be used for GARDENING & SECURITY purposes only and no structures other than the non-permanent visually permeable boundary fencing will be permitted within the lease area;

The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
-
Subject to further conditions to be imposed by the Director: Property Management in terms of her delegated authority;

Subject to compliance with any other statutory requirements;

Building plans must be submitted to the City of Cape Town’s Planning and Building Development Management Department for approval prior to the commencement of building work;
-
The applicant needs to maintain the property in the neat and tidy condition at all times so as not to cause a health nuisance;
-
All waste from the clearing of the vegetation on the property must be suitably disposed of. In this regard, no burning of vegetation will be allowed to take place on the property;
-
The property must be suitably enclosed to prevent any nuisances from arising;
-
No compensation will be payable for any improvement made to the property;
-
The submission and approval of any necessary building plans in terms of the National Building Regulations;
-
Any fencing that does not require the submission of plans in terms of the National Building regulations will still require the approval of the Director: Property Management prior to the erection of such fence;
-
Any alterations or deviation to electricity services necessary as a consequence of the proposal or requested by the applicant will be carried out at the applicant’s cost;

It is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan;
-
The applicant shall be responsible for any cost involved in the deviation or the removal of existing Telkom plants due to the development of the property;
-
It must be made known to the applicant that Telkom requires access to carry out maintenance or upgrade existing plants at all times;
-
If any plant not indicated exist and information or supervision is required, the applicant is to contact Telkom at least 48 hours before any work commences;
-
The premises must comply with the National Building Regulations and by-law relating to community fire and safety and any other applicable legislations;
-
Adherence to the requirements of the City of Cape Town’s water by-law;
-
Settlement of all outstanding accounts with the City of Cape Town, if any.
