RESOLVED TO RECOMMEND
a) Subcouncil 20 supports the recommendation that:
a) In terms of Sections 14(2)(a) and (b) of the Local Government Municipal Finance Management Act (MFMA), Act 56 of 2003:
i) Council resolve that the Portion of Unregistered Consolidated Erf 155306 (comprising of Portions of Erven 155256, 155257) and Split Remainder of Erf 83348, situated at No. 52A & 56A White Road, Retreat Industrial Area, approximately 4 326m² in total, zoned Open Space 2, General Industrial Subzone G12 and Transport Zone 2, shown lettered ABCD on the attached Disposal Plans (Annexure A) are not required for the provision of the minimum level of basic municipal services;
ii) Council confirm that the fair market value of the asset described in (a)(i) and the economic and community value to be received in exchange for the asset described in (a)(i) have been considered;
b) In terms of Regulation 5(1)(b) of the Municipal Asset Transfer Regulations (MATR), R. 878 promulgated on 22 August 2008, Council approve in principle the sale of the Portion of Unregistered Consolidated Erf 155306 (compromising of Portions of Erven 155256, 155257) and Split Remainder of Erf 83348, as described in (a)(i) above; and
c) The Portion of Unregistered Consolidated Erf 155306 (compromising of Portions of Erven 155256, 155257) and Split Remainder of Erf 83348 situated at No. 52A & 56A, White Road, Retreat, be sold by public competition, subject to Conditions to be imposed be the Director: Property Management in the exercise of her Delegated Authority.
