PROPOSED CLOSURE AND GRANTING OF IN-PRINCIPLE APPROVAL FOR THE SALE, BY PUBLIC COMPETITION OF VACANT ERF 6291 BELLVILLE AND A PORTION OF REMAINDER ERF 6139 BELLVILLE, NOORD STREET, CHRISMAR BELLVILLE, FOR RESIDENTIAL PURPOSES

Resolution detail

Subcouncil 6 noted and recommended to the Council the following:

That in terms of Section 14(2)(a) and (b) of the Local Government: Municipal Finance Management Act (MFMA), Act 56 of 2003;

Council resolve that Erf 6291 and portion of remainder of Erf 6139, situated at Noord Street, Chrismar, Bellville in extent approximately 9 427m², zoned Open Space 2: Public Open Space (OS2) and Transport 2: Public Road and Public Parking shown lettered ABCDEFGHJKLM on Plan LIS 1640v0 (Annexure A), not be required for the provision of the minimum level of basic municipal services;
Council confirm that the fair market value of the asset described in (a) (i) and the economic and community value to be received in exchange for the asset described in (a)(i) have been considered.

That in terms of regulation 5(1)(b) of the Municipal Asset Transfer Regulations (MATR) R.878 promulgated on 22 August 2008, Council approve in principle the sale of Erf 6291, Bellville and portion of remainder 6139, Bellville as described in (a)(i);
That Erf 6291 Bellville and portion of remainder Erf 6139, Bellville be transferred of by public competition, subject to conditions to be imposed by the Director: Property Management in the exercise of her delegated authority;
That any gain or loss incurred by the municipality in respect of the transfer of the asset be included on the adjustment budget of the municipality (Section 28 and 87 of the MFMA), if not budgeted for in the approved annual budget;
That in terms of Section 4 of the Immovable Property By-law, 2015, Council approve the closure of Erf 6291 – Bellville Belmont Street, Chrismar, being a Public Place.
