UANIMOUSLY RESOLVED that the proposed lease of portion of public street abutting Erf 584 Cape Town, situated at 21 Dixon Street, De Waterkant, for outdoor seating purposes:  Barleda 745 CC T/A Café Manhattan BE DEFERRED, to allow the Health Department to make a noise assessment to determine whether the impact of the use of the tables on the public sidewalk would exceed the noise rating level for the type of district, and that the noise assessment outcome be submitted with the report to the next Subcouncil meeting.


12/06/2019:UNANIMOUSLY RESOLVED TO RECOMMEND that: The lease  of portions of public street, situated at 21 Dixon Street, De Waterkant, shown hatched and lettered ABCD and EFGH on  the  attached sketch STC 2659 marked  annexure A attached to the report, in extent approximately 32m²,and 27m² respectively, to Barleda 745CC t/a Manhattan, owner of Erf 584 Cape Town  or its successors in title, be approved subject to inter alia the following conditions, that:

  1. A market rental of R4200 per month inclusive of rates and excluding VAT calculated at the rate applicable at the time of transaction be payable. The monthly rental is to escalate at 8% per annum compounded annually commencing 2018-05-01. Beneficial occupation of R4200 per month inclusive of rates and exclusive of VAT is payable as from 2018-07-01 until the lease has been signed. Rental to be reviewed after a period of 5 years.
     
  2. The rental will escalate at 8% per annum
     
  3. The lease will endure for a period of ten years
     
  4. The property be used for outdoor seating purposes only 
  5. Subject to such further  conditions  to be  imposed by the Director: Property Management in terms of her delegated authority;
     
  6. Subject  to compliance  with any  other statutory requirements, including all Council by-laws;
     
  7. No compensation will be payable for any improvement made to the property
