Subcouncil 12 RESOLVED : To recommend that the lease of a portion of public street ,being a portion of ervens 17122 and 16612 Mitchells Plain situated between Burgundy Crescent and Kylemore Close, Westridge shown hatched and lettered ABCDEF on the attached plan LT1080v.1 marked Annexure A, in extent approximately 140m2, to Mildred O'Connel, owner of Erf 16611 or her successors in title, be APPROVED subject to inter alia the following conditions, that: a) A tariff rental of R835.65 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable; b) The lease will endure for a period of ten years with the option to renew for a further ten years; c) The rental will be adjusted annually in terms of the rental tariff structure as approved by Council; d) The property be used for security purposes only and no structures other than existing boundary fencing will be permitted in the area; e) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority; f) Subject to compliance with any statutory requirements; g) No compensation will be payable for any improvement made to the property; h) Any boundary fencing is to be of a non-permanent type, and the submission and approval of any necessary building plans in terms of the National Building Regulations if applicable; i) Any fencing that does not require the submission of plans in terms of the National Building Regulations will still require the approval of the director: Property Management; j) Electricity services exist within the lease area and any alteration or deviation to electricity services as a consequence of the proposal, or requested by the applicant, will be carried out at the applicants cost; k) No excavation is to take place on site without the possession of a wayleave and works permit; l) No Telkom services are known to exist within the vicinity of the lease area but it is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan; m) It must be made known to the applicant that Telkom requires access to carry out maintenance or upgrade existing plant at all times; n) The applicant must comply with the (NBR) and By-Law relating to community Fire Safety and other applicable legislation.
