UNANIMOUSLY RESOLVED to RECOMMEND that:
a)the lease of the City Land, being Erf 5744, portions of Erven 5745, 5746, 5747 -5760 and 5766- 5773 Cape Town situated between Canterbury and Primrose Streets, Cape Town shown hatched and lettered ABCDEFGH on the plan STC 2818 marked annexure A, attached to the report in extent approximately 2530m², to Protea Helpende Hand Wes-Kaap, or their successors in title, BE APPROVED subject to inter alia the following conditions that:
b)In respect of beneficial occupation, a tariff rental of R240 000 is payable for the period 2016-04-01 to 2017-03-31 and for the period 2017-04-01 to 2017-06-30 a monthly rental of R64 800 is payable and thereafter R21600 per month;
c)The rental is exclusive of rates and VAT and is to escalate at 8% per annum as from 2017-04-01. The lease is for a period of 5 years, as from the date of signing the lease agreement, with the first two years being fixed, thereafter a twelve-month notice period by both parties;
d)The lease will endure for a period of five (5) years, with the first two (2) years being fixed;
e)Notwithstanding the proposed lease period being 5 years, with the first two years being fixed, the Lessor may cancel or amend the lease after the initial fixed period of two years with one year’s notice - and resume possession of the whole or any portion of the Land should it be required for any Municipal or Government purposes, but also for market-driven development that would potentially be packaged at any time by giving due notice, due to the proposed precinct redevelopment.
f)The property be used for parking purposes only;
g)Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
h)Subject to compliance with any other statutory requirements;
i)No compensation will be payable for any improvement made to the property;
j)The following conditions be added:
(i)Physical security to be provided on-site
(ii)The site must be tarred
(iii)The site must be fenced
