Resolution detail
Councillor van Reenen made reference to folio page 232 of the report and expressed the incorrectness of the DLO Report. She said that the licenced premises have religious institutions, educational institutions as well as a petrol station in the immediate vicinity. However, the DLO Report stated the proximity of the licensed premises are not surrounded by religious and educational facilities. It must also be noted that the vicinity of where the licensed premises is situated, is a residential zone.
Councillor Esau highlighted the following:
• During the community participation process various residents and abutting neighbours contacted the Ward Councillor’s Office, objecting to the granting of the extended trading hours in respect of the licensed premises. The residents however requested anonymity.
• On-going shootings and crime in the area is a concern and approval of the extension of trading hours might add to this predicament.
With the above in mind, the outcome of the community
consultation reflected that the application to extend the Sunday trading hours be refused.
The objections, which also forms part of the DLO Report, received from the Community Police Forum Elsies River is as follows:
13 December 2016: A man was fatally wounded in a shooting incident opposite the premises. The applicant’s daughter was also injured. (CAS 251/12/2016);
21 April 2017: A patron was fatally wounded, due to a shooting incident on the premises. (CAS393/04/2017);
25 November 2017: Elsies River SAPS conducted an operation on the premises, the Colonel leading the inspection, noticed workers of the licenced premises bringing liquor from the adjacent property. Upon investigation masses of liquor were found on the adjacent property. The owner of the adjacent property was arrested and the liquor confiscated.
RESOLVED
That the Application for Extension of Liquor Trading Hours from 11:00 to 18:00 Sunday Trading for Off-Consumption Premises in respect of: Wimpies Liquor Store, erf 9010, 187 Halt Road, Elsies River, Licence Reference Number: WCP/035116 BE REFUSED due to the following reasons:
• During the community participation process various residents and abutting neighbours contacted the Ward Councillor’s Office, objecting to the granting of the extended trading hours in respect of the licensed premises. The residents however requested anonymity.

That the deferred item: Application for extension of liquor trading hours from 11:00 to 18:00 Sunday trading for off-consumption premises in respect of Wimpies Liquor store, erf 9010, 187 Halt Road, Elsies River, Licence reference number: WCP/035116 – Ward 30 BE DEFERRED for rectification due to the following:
• Public Participation comments displayed on Page 196 made reference to The Ward Councillor and registered within Ward 26; and
• The recommendation made reference to Vasco Liquors instead of Wimpie’s Liquors store.
