Resolution detail

a) That in terms of Regulation 41(2)(e) of the Municipal Asset Transfer Regulations, portion of Erven 7393-7409, Goodwood situated at the corner of Voortrekker and Molteno Road in extent approximately 4017m² is surplus to the requirements of the Municipality b) The proposed lease of City land being a portion of Erven 7393-7409, Goodwood shown lettered ABCDEFGHJKLMNPQRS on the attached sketch plan 482v0 marked Annexure A in the report, in the extent approximately 4017m², to National Government of the Republic of South-Africa – Deaprtment of Public Works (Department of Justice – Goodwoods Magistrates Court) or their successors-in-title, be approved subject to inter-alia the following conditions: i) A market rental of R254 071 per month inclusive of VAT and rates escalating at 8% per annum; ii) The lease will endure for a period of ten (10) years; iii) The property to be used only for Magistrate Court purposes; iv) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority; v) Subject to compliance with any other statutory requirements; vi) The lessee be liable for rates as determined in terms of the Valuation Roll; vii) No compensation will be liable for any improvement made to the property, with or without the consent of Council, should the lease be terminated for any reason whatsoever.
