RESOLVED TO RECOMMEND 1. Subcouncil 20 supports the recommendation that the lease of public street, being a portion of Erf 49375 Cape Town, situated at Van Reenen Street, Newlands, shown hatched and lettered ABCD on the attached plan STC 2791 marked annexure A, in extent approximately 100m², to MTN (Pty) Ltd, or its successors in title, be approved, subject to inter alia the following Conditions, that: a) A tariff rental of R9 914.40 per month excluding VAT of 14% where applicable, being R1188.02 (in total – R11 302.42) be payable; b) The lease will endure for a period of ten years; c) The rental will escalate at 8% per annum; d) The property be used for telecommunication infrastructure purposes only; e) Subject to such further Conditions to be imposed by the Director: Property Management in terms of her delegated authority; f) Subject to compliance with any other statutory requirements; g) No compensation will be payable for any improvement made to the property. FURTHER RESOLVED TO RECOMMEND 2. Subcouncil 20 requests that all reference regarding the rental “per annum” be corrected to reflect “per month” in the departmental report.
