RECOMMENDED that, The lease of portion of public street, being portion Erf 7000, Fish Hoek, shown hatched and lettered ABCDEFG on the attached Plan LT 222v2 and marked annexure A, in extent approximately 104m², to Mr BO and Mrs J Clements, owners Erf 8482, Fish Hoek or their successors in title be approved, subject to inter alia the following conditions, that: a)The lease will endure for a period of ten years with an option to renew for a further ten years; b)A tariff rental of R791, 00 per annum excluding VAT of 14% where applicable, being R110,74 (in total – R 901, 74) be payable; c)Payment of annual rates will apply, if applicable; d)The rental will be adjusted annually in terms of the rental tariff structure as approved by council; e)The land will be used to regularise an existing boundary encroachment only; f)No structure other than the existing encroachment fence will be permitted within the lease area; g)Any alterations or deviations to electricity services necessary as a consequence of the proposal, or requested by the applicant, will be carried out at the applicant’s cost; h)Electrical infrastructure may exist on the property or in its vicinity. A way leave shall be obtained from Electricity Services Department before any excavation work may commence; i)It is the responsibility of the applicant to notify Telkom immediately should the applicant locate Telkom Plant which might not be indicated on the plan; j)It must be made known to the applicant that Telkom requires access to carry out maintenance or upgrade existing plants at all times; k)Where a water meter exists, should be accessible for water meter reading and maintenance purposed by City of Cape Town; l)Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority; m)Subject to compliance with any other statutory requirements; n)No compensation will be payable for any improvement made to the property; o)All outstanding accounting accounts with the City of Cape Town must be settled.
