RECOMMENDED that, the lease of a public street, abutting erf 89044, Cape Town situated at Clovelly Road, shown hatched and lettered ABCD on the attached sketch SN 26595 marked annexure A, in extent approximately 2m², to RSH Beck and HM Van der Veen, owner of Erf 89044, Cape Town or their successors in title, be approved subject to inter alia the following the conditions, that: a)A tariff rental of R987.72 per annum excluding VAT of 14% where applicable, being R138.28 (in total – R 1126) be payable; b)The lease will be endured for a period of ten years; c)The rental will be adjusted manually in terms of the rental tariff structure as approved by Council; d)The property be used for security purposes only and no structures other than the existing structures will be permitted on the leased area; e)Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority; f)Subject to compliance with any other statutory requirements; g)Any fencing that does not require the submission of plans in terms of the National Building Regulations will still require the approval of the Director: Property Management; h)Any alteration or deviation to electricity services necessary as a consequence of the proposal, or requested applicant, will be carried out at the applicant’s cost; i)A minimum clearance of 3m to the overhead mains conductors is to be maintained at all times. Should these clearances not be maintained for any reason, the necessary alterations will be carried out by the Electricity Department at the applicant’s cost; j)It is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which not be not be indicated on the plan; k)It must be known to the applicant that Telkom requires access to carry out maintenance or upgrade existing plants at all times; l)Unrestricted access into the area shall be available 24 hours a day to personnel of Water Branch; m)Adherence to the requirements of the City of Cape Town’s water by-law. n)The applicant’s debt profile has been verified and he is arrears have been settled. o)No compensation will be payable for any improvement made to the property. p)All outstanding accounts with the City of Cape Town must be settled (remove clause if not applicable); ACTION: SECRETARTIAT / WILSON BAARTMAN
