For the reasons set out in the report, it was RECOMMENDED that, The lease of portion of Public Street, being a portion of Erf 1252 Simon’s Town situated at Churchill Avenue, Simon’s Town shows hatched and lettered A foot of retaining wall BC back edge of footway DEFGH on the attached sketch WT 20001412 marked annexure A, in extent approximately 150 m2. To Mr J & Mrs K Van Der Heuvel, owners of Erf 3020 or their successors in title be approved subject to inter alia the following conditions, that: a)A tariff rental of R742.98 per annum excluding VAT of 14% where applicable, being R 104.02 (in total R 847.00) be payable; b)The lease will endure for a period of ten (10) years with an option to renew for ten (10) years; c)The rental will be adjusted annually in term of the rental tariff structure as approved by Council; d)The land will be used for gardening purposes only and no structure than existing boundary walls/fencing will be permitted within the lease perimeter, subject to the submission and approval of all necessary building plans; e)Subject to such further conditions to be imposed by the Director : Property Management in term of her delegated authority; f)Subject to compliance with any other statutory requirements; g)Any alterations or deviations to electrical services necessary as a consequence of the proposal, or requested by the applicant will be carried out at the application’s cost; h)It must be made known to the applicant that Telkom requires access to carry out maintenance or upgrade existing plants at all times; i)It is the responsibility of the applicants to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan; j)Vegetation at the intersection of Waveli and Church Avenue to be trimmed so as not interfere with line of sight of motorist; k)No trees to be planted over the storm water pipe; l)The Council shall have the right of access at all times for the purposes of maintaining and repairing the sewer. m)Application to Purchase/sale be refused as per branch comment as asset needed to provide the minimum level of basis Municipal services; n)Adherence to the requirements of the City of Cape Town’s water by-law. o)No compensation will be payable for any improvement made to the property.
