Delegated: for decision by the Immovable Property Adjudication Committee (IPAC): It is recommended that the lease of portion of Erf 919, being portion of public Street situated at Muchbinding Close, Wetton, shown hatched and lettered ABCDEF on the attached sketch NP 20000431 marked annexure A, in extent approximately 28m², to Mr Yaseen Parker and Mrs Rachma Parker, owners of Erf 933 Wetton, or their successor in title, to regularize an encroachment into City land be approved subject to inter alia the following conditions, that: a) A market rental of R300.00 per month excluding VAT of 14% where applicable, being R42.00 (in total – R342.00) be payable, escalating at 8% per annum, for a period of 10 years. b) The lease will endure for a period of ten years, the rental to be reviewed after five years; c) The land will be used to regularize the existing swimming pool outdoor area built on the Council land and no other structures whatsoever is permitted within the lease footprint; d) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority; e) Subject to compliance with any other statutory requirements; f) No compensation will be payable for any improvement made to the property; g) All outstanding accounts with the City of Cape Town must be settled; h) The applicant shall be held responsible for any cost involved in the deviation or removal of existing Telkom plant due to the development of the property; i) 24 hour access to Telkom services must be available in order to carry out maintenance or upgrade existing plants at all times. j) Any alteration or deviation to electricity services necessary as a consequence of the proposal, or requested by the lessee, will be carried out at the lessee’s cost. k) Where a water meter exists it should be accessible for water meter reading and maintenance purposes by the City of Cape Town staff;
