UNANIMOUSLY RESOLVED that:
An administrative penalty of R 750 000.00 for the unauthorised land use (boarding house) and unauthorised building work (portions of rental-boarding rooms) BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 (as amended) in respect of Erf 318, Milnerton.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add a reason as follows:

6.7 Similar previous contraventions, the persistent ignoring of notices issued by Council inspectors, and the wilful misrepresentation which contravenes Section 78 of the MPBL warrants a significant increase in the penalty amount.
