RESOLVED by 3 votes to 2 that:
An administrative penalty of R 10 000.00 BE APPROVED for the unauthorised building work in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 2817 Oranjezicht.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reasons as follows:

6.1 The extent of the building work contravention is approximately 95.96m². which is is large
6.2 The building works contravention were undertaken in 2009 which is long
6.3 The conduct of the owner appears to be negligent as due diligence was not done
6.4 The gravity of the building work contravention is considered to be serious as it comprises of habitable space and the property is in an HPOZ and no assessment of the impact of the building work on heritage resources was done.
