RESOLVED that:
a. The application for rezoning of Erf 8682 Constantia, from Single Residential Zone 1 to Local Business Zone 1, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
b. The application for consent for a place of instruction for Erf 8682 Constantia, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
c. The application for consent for an institution, as set out in Annexure A, for Erf 8682 Constantia, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
d. The application for departures, as set out in Annexure A, for Erf 8682 Constantia, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
Amended Condition
2.1.1 The use of the property is restricted to (1) offices (for one entity at a time only) or (2) an institution in the form of a rehabilitation centre, with only one of these uses operational on the property at any one time.
REASONS FOR DECISION:
The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s report, except reason 7.1.8 and 7.1.11 which are corrected as follows:
7.1.8. Conditions will significantly mitigate the impact of the proposal, specifically relating to the use of the property and not allowing any building extensions.
7.1.11. Although the proposal for offices is not consistent with the 2023 Southern District Plan, it is reasonable to deviate from the Southern District Plan for the reasons stated in the assessment above.
