RESOLVED UNANIMOUSLY:

An administrative penalty in the amount of R3 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015, in respect of Erf 49631, Mitchells Plain, concerning the unauthorised building work in the form of a dwelling extension and veranda as shown on the plan with plan no 49631, dated October 2022.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report and added an additional reason that reads as follows:

6.7. The serious nature of the contravention and the fact that it is a double storey extension warrants an increase in the penalty.
