UNANIMOUSLY RESOLVED that:
An administrative penalty of R 1 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 5893 Wesfleur, for the unlawful enclosed braai area and that such penalty be approved in terms of Section 98(b) of the said By-Law.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 6.3 as follows:
6.3 The structure has no negative impact on the street building line and subsequently has no adverse impact on the streetscape. This warrants a decrease in the penalty amount
