Resolution details

RESOLVED UNANIMOUSLY that:

a. The application for amendment conditions 3 and 4 of the previous approval pertaining to LUM Case: 70274469 in respect of Erf 24705, Parow BE APPROVED, in terms of the Section 98(b) of the Municipal Planning By-Law 2015, subject to the conditions attached as Annexure A, in accordance with Site Development Plan attached as Annexure C.

b. The application for consent use to allow for a supermarket in respect of Erf 24705, Parow BE APPROVED, in terms of the Section 98(b) of the Municipal Planning By-Law 2015, subject to the conditions attached as Annexure A, in accordance with the Site Development Plan attached as Annexure C.

c. The application for permanent departure to allow for construction of a 3m high non-permeable boundary wall along Eike Avenue in lieu of a height of 2m and 25% visual permeability in respect of Erf 24705, Parow BE APPROVED, in terms of the Section 98(b) of the Municipal Planning By-Law 2015, subject to the conditions attached as Annexure A, in accordance with the boundary wall proposal attached as Annexure K.
ANNEXURE A
All conditions under the heading 2.3 are deleted
Conditions 2.5.4, 2.5.5, 2.7.8 and 2.7.9 are deleted
Conditions 2.4.1. 2.7.5 and 2.7.6 are amended as follows:
2.4.1. That a landscaping plan shall be submitted to this department for approval by the Authorized Official prior to building plan approval. Such plan shall include, with the consent of the owner of Erf 23173, landscaping along the boundary wall of the erf bordering onto Erf 24705, to mitigate the noise and visual impact.
2.7.5. That underground and overland stormwater systems, including fully vegetated and/or stabilized attenuation and treatment facilities, must be constructed and completed, prior to Section 137 Clearance Certification.
2.7.6. That stormwater Operation and Maintenance Agreement, between the developer and the City, must be concluded prior to 554(b) or Section137 Clearance.
Additional conditions
2.9.1 That deliveries to the northern delivery yard be limited to the hours of 10:00 to 15:00.
2.9.2 That no deliveries to take place on Sundays and Public Holidays.
2.9.3 That the boundary wall facing on to erf 23173 to be built to a height of 2.5m measured from the existing ground level on erf 23173 to the top of the wall.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons in the Planner’s report
