Resolution details

RESOLVED that:

a. The application for rezoning of Remainder Erf 4743 Noordhoek, from Rural Zone to Community Zone 1, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

b. The application for a departure, as set out in Annexure A, for Remainder Erf 4743 Noordhoek, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

Amended conditions:

2.2.4 The access off Silvermine Road must be via a roundabout designed to acceptable geometric standards and must be located a minimum of 150m east of the Noordhoek Main/Silvermine Road intersection and 60m from the Village Lane/Silvermine Road intersection.

2.2.7 A minimum 1.8m wide sidewalk shall be constructed along the property frontage only and adequate road markings and road signage must be implemented along Silvermine Road to warn drivers of these vulnerable road users, this must include safe crossing points at strategic location on Silvermine Road. The detailed plan must be approved by the Transport Directorate and must be submitted prior to or simultaneously with the building plans.

2.2.9 The place of instruction must implement a staggered start time for the junior and senior grades.

that the spelling of the word “learners” be corrected in condition 2.2.8

REASONS FOR DECISION

The MPT APPROVED the application for the reasons set out in the Planner’s report and amended reason 7.10 and added additional reasons 7.16, 7.17 and 7.18 that reads as follows:

7.10 The departure relating to the width of a carriageway crossing is technical in nature and arises from the TIA to promote safe vehicular access to the school and will furthermore not have any negative impact on any party.
7.16 The rezoning of the property for educational purposes complements the existing retail, rural and residential uses in the broader area and facilitates a more balanced urban development environment.
7.17 Due consideration has been given to the development principles contained in Section 7 of the Spatial Planning and Land Use Management Act, No. 16 of 2013 and Section 59 of the Land Use Planning Act No.3 of 2014.
7.18 The proposal presents a spatial logic that responds meaningfully to its location and is considered to satisfy the desirability criteria contained in Section 99 (3) of the Municipal Planning By-Law.
