RESOLVED that:
The application for a temporary departure, as contained in Annexure A, for Remainder Erf 3341 Constantia, BE REFUSED in terms Section 98(c) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
The MPT REFUSED the application for the reasons set out below:
1. The proposal will have a negative visual impact on the surrounding area and it would be very difficult to entirely mitigate the negative visual impact of the tent structures.
2. The proposed noise mitigating measures will not adequately address the noise nuisance to the surrounding properties, given that the land use activities will be conducted from tent structures.
3. The intensity of the development is not appropriate on this site which is on the periphery of the urban area.
