RESOLVED UNANIMOUSLY that:

a. The application for deletion of a restrictive title deed condition, as set out in Annexure A, for Remainder Erf 68058 Cape Town at Wynberg, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b. The application for the rezoning of Remainder Erf 68058 Cape Town at Wynberg from Single Residential Zone 1 to Subdivisional Area, BE APPROVED in terms of section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

c. The application for the subdivision of the Remainder Erf 68058 Cape Town at Wynberg, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per plan of subdivision LUM/00/68058/1.

d. The application for departures, as set out in Annexure A, for Remainder Erf 68058 Cape Town at Wynberg, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

APPLICATIONS GRANTED 1.2 is amended as follows:

1.2 To subdivide the property into 2 portions (Portion A: ±20m² and Portion B: ±2959m²) as per the plan of subdivision LUM/00/68058/1.

Condition 2.1.4, 2.5.2 and 2.7.1 are amended as follows:

2.1.4. No more than 39 residents for the institution shall reside on the property at any one time.

2.5.2 The owner/developer shall pay a development charge (DC) in accordance with the approved Development Charges Policy for Engineering Services for the City of Cape Town. The total amount payable for the proposed land use right in accordance with the attached DC calculation is R356 951.63. This amount is valid until 2021-06-30 and that the amount due will be escalated annually with the Construction Price Adjustment Formula (CPAF) using the industry indices of StatsSA. The DC is payable prior to approval of building plans.

2.7.1 A minimum of 18 on-site parking bays must be provided.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report.
