RESOLVED UNANIMOUSLY that:
That an administrative penalty in the amount of R3000 for the unauthorised building work BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 on erf 2993, Ottery be approved in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report, except reason 6.4 which is amended as follows:
6.4 The gravity of the upper floor contravention is considered to be potentially serious, this warrants an increase in the penalty amount.
