RESOLVED UNANIMOUSLY that:

The application for Consent for a rooftop base telecommunication station and permanent building line departures, as set out in Annexure A, for Erf 29711 Cape Town BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015.

Annexure A

That the erf number “27911” be corrected to “29711”


REASONS FOR DECISION:

The MPT REFUSED the application for the reasons set out in the Planner’s report, except reason 7.1.1 and 7.1.4 which is amended as follows:

7.1.1 The proposed 11m rooftop base telecommunication station, negatively impacts on the rights of the surrounding property owners to develop their properties in accordance with the Single Residential Development Rules as set out in the Development Management Scheme. In this regard, the height of the mast is too low and the potential buildings will be habitable and within the 50m health and safety zone, as is stipulated in the Council approved Telecommunication Mast Infrastructure Policy (2015).
7.1.4 Although the proposal would be of benefit from an economic development point of view, the proposed mast is generally inconsistent with the City’s Telecommunication Mast Infrastructure Policy insofar as co-location opportunities and health and safety requirements are concerned.
