Resolution details

UNANIMOUSLY RESOLVED that:
a. The application for City approval in terms of the Development Management Scheme and departures as set out in Annexure A, on Remainder Erf 172004 Cape Town, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law 2015, subject to the conditions contained in the attached Annexure A.

b. The application for departures as set out in paragraph 2.1.4 in Annexure A, on Remainder Erf 172004 Cape Town, BE REFUSED in terms of Section 98(c) of the City of Cape Town Municipal Planning By-Law 2015.

REASONS FOR DECISION
The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s Report and agreed that the following reasons be deleted:

Delete reason 6.2.1
Delete reason 6.2.3

Amend Annexure A as follows:
The following conditions were GRANTED by 4 votes to 1:
2.1.1 Item 64(c): To permit the fourth storey of the building (between 10m and 25m in height above base level) to be 0m in lieu of 4.5m from the north eastern common boundary

2.1.3 Item 64(c): To permit the fifth and sixth storeys of the building (between 10m and 25m in height above base level) to be 0m in lieu of 4.5m from the north eastern common boundary

Departure 2.1.2 is approved unanimously
Departure 2.1.4 was unanimously refused






Amend condition 3.1 as follows:
3.1 The north-western portion of the building may not contain any trafficable balconies or terraces, and only contain structures needed to maintain the roof. A revised plan be submitted aligned to the departures granted and departures refused by the MPT to the satisfaction of the authorized official
