UNANIMOUSLY RESOLVED that:
a. A deviation from the Khayelitsha/Mitchells Plain/Greater Blue Downs District Spatial Plan on erf 172883, 40 Spanner Crescent, Philippi BE SUPPORTED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 to permit high density residential use instead of general industrial use
b. The application in terms of Section 42(a) of the City of Cape Town Municipal Planning By-Law, 2015 for the rezoning of Erf 172883, 40 Spanner Crescent, Philippi, from General Industry1 (GI1) to General Residential 2 (GR2), BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions attached to Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reason set out in the Planner’s Report and agreed that reason 7.1 be deleted
Amend Annexure A as follows:
Delete 1.1
Amend paragraph 2.1 to read as follows:
A site development plan for the 110 units be submitted for approval by the authorized official prior to the submission of building plans for approval in terms of the National Building Regulations and Standards Act. Such a plan shall include the following:
In paragraph 2.1, add the following bullet point:
A landscape plan to be submitted which includes planting of trees
In paragraph 2.1, amend the last bullet point as follows:
An operational management plan, to be enforced by the owner and to be submitted for council records, is to indicate how the development will be managed after construction and occupation.
Amend paragraph 2.2 as follows:
A noise management plan, inclusive of all the recommendations as stipulated in the Noise Management Plan submitted by Machoy Consulting Acoustic Engineers be implemented, shall be submitted concurrently for approval together with the submission of the site development plan referred to in 2.1 above.
Amend paragraph 2.14 as follows:
A landscape master plan shall be submitted for the approval of the authorized official after consultation with the Director: Social Services (Recreation and Parks), concurrently with the submission of the SDP referred to in 2.1 above, which shall be implemented by and at the cost of the developer.
Amend paragraph 2.18 as follows:
The developer shall obtain a written undertaking from the relevant Electricity Distribution Service Provider that the additional required bulk electricity capacity is available from the ESKOM intake point. Such undertaking must be signed by the Head of the Department at ESKOM prior to obtaining building plan approval
