RESOLVED UNANIMOUSLY

That the application for the subdivision of Erf 4332 Simon’s Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per plan of subdivision LUM/67/4332, subject to the conditions contained in Annexure A.



ADDITIONAL CONDITION

- That the remainder of erf 4332 be limited to one dwelling unit.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report, except reason 7.1.6 which was amended as follows

7.1.6 Although the subdivision is not consistent with the Simon’s Town Structure Plan which specifies a minimum erf size of 450m2, the deviation from the Structure Plan is justified for the reasons listed in the assessment above and in particular reason 7.1.10 below
