RESOLVED UNANIMOUSLY:

That an administrative penalty in the amount of R 1000 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 148825, Rugby, for the unlawful building work, and such penalty be approved in terms of section 98(b) of the said By-Law.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the planner’s report and amended reason 6.4 as follows:

6.5 The unlawful structures are not deemed to be a threat to the safety, health and wellbeing of the surrounding community and warrant a reduction in the penalty
