UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 10 000.00 BE DETERMINED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of the unauthorised building work on Erf 15484, 2 Parel Vallei Heights, Somerset West.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report, except reason 6.2 and 6.3 which are amended and added two additional reasons that reads as follows;

6.1 The owner did not take into consideration the concerns raised by the Home Owners Association and proceeded to construct the retaining wall without building plans.
6.2 The gravity of the contravention is serious.
6.6 The owner has not provided a motivation for the unauthorised building work
6.7 The owner refused to apply for an administrative penalty
