UNANIMOUSLY RESOLVED that:
a. The application for the consent as per Condition E.6(b) registered in Title Deed T37057/2014 to permit the proposed garage and second dwelling at 3.713m and 5.695m respectively along Broadlands Road in lieu of 7.87m, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in attached Annexure A.

b. The application for the consent as per Condition E.6(b) registered in Title Deed T37057/2014 to permit the proposed garage 1.107m in lieu of 3.15m from the common building line (adjacent to Erf 6934), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in attached Annexure A.

c. The application for the following permanent departures from the DMS on Remainder Erf 6935, Somerset West, as indicated on Plan No “Council sub” dated May 2019, BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions contained in attached Annexure A:

- the relaxation of the 6.5m width restriction applicable to garages to 6.77m;
- the relaxation of the 3.5m height restriction applicable to garages to 4.86m;
- the relaxation of the 5m street building line (along Broadlands Road) to 3.713m for the proposed
- garage;
- the relaxation of the street building line (along Broadlands Road) from 6m to 5.695m for the proposed
- second dwelling; and
- the relaxation of the common building line (adjacent to Erf 6934) from 6m to 3.838m for the proposed
- second dwelling.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.

Amend Annexure A:
Correct spelling in the heading above paragraph 2.1 to read as follows:
