UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 100 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 1615, Camps Bay.

REASONS FOR DECISION
The MPT APPROVED the application for the following reasons:

1. The extent of the land use contravention is considered to be very large, ie the entire property of 1544m²
2. The gravity of the continued land use contravention is considered to be serious and could have negative health and safety risks to the occupants.
3. The unauthorised building work was constructed without prior approval from Council and the duration of the contravention is considered to be long as it has been in existence for 9 years and 7 months and has not ceased.
4. The quantum of the penalty is determined by the value of the property, which is at R40m
