UNANIMOUSLY RESOLVED that:
The application for deletion of title deed restrictions E.5(a), E.5(c) and E.5(d), deletion of approval conditions and subdivision as set out in Annexure A, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, in accordance with the subdivision plan attached as Annexure C and subject to the conditions contained in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Condition E.5(b) is refused for the following reasons:
In the absence of an SDP, the applicant has not demonstrated that densification would not be excessive
Amend Annexure A:
Remove old clause 1.2.2 and 1.3.2 which refer to condition E.5(b) and replace them in new paragraph 1B as follows:
1B APPLICATIONS REFUSED IN TERMS OF SECTION 98(c) OF THE BY-LAW
Proposed deletion of the following title deed condition (Section 42(g) and proposed deletion of the following condition (Section 42(j):
Title deed T91179/94, condition E.5(b) which reads as follows: ‘It shall only be used for the purposes of erecting thereon one dwelling, together with such outbuildings as are ordinarily required to be used therewith.’
Add new 3.2 and 3.3 as follows:
3.2 Since the applicant has not motivated the public benefit in relation to the subdivision, that the development rules of properties larger than 650m would apply.
3.3 That a 3m building line be imposed on the northern common boundary
