RESOLVED UNANIMOUSLY that:
a. The application for rezoning of Remainder Erf 83144, Erf 83145 and Remainder Erf 83146 Cape Town at Retreat from Single Residential Zone 1 to Mixed Use Subzone MU1, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
b. The application for consolidation of Remainder Erf 83144, Erf 83145 and Remainder Erf 83146 Cape Town at Retreat, as per the plan of consolidation LUM/00/83144, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
c. The application for a departure, as set out in Annexure A, Remainder Erf 83144, Erf 83145 and Remainder Erf 83146 Cape Town at Retreat, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
d. The application for Council’s approval in terms of Item 64(e) of the Development Management Scheme, as set out in Annexure A, for Remainder Erf 83144, Erf 83145 and Remainder Erf 83146 Cape Town at Retreat, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law.
That the plan number and date at the top of Annexure A be amended as follows:
The departure is linked to the plans drawn by Jonathan Hill Architects, with drawing number 171003 C dated 18 November 2019.
AMENDED CONDITIONS
2.1.1 The building envelope is restricted to those buildings shown on the plan drawn by Jonathan Hill Architects, with drawing number 171003 C dated 18 November 2019.
2.1.3 The land uses on the consolidated property are limited to the manufacture, storage and sale of paving slabs, and the operation of a plumbing business, retail and office uses.
2.2.3 Access/egress to/from the property is limited to the existing carriageway crossings off Military Road only. The vehicular access gates shall be set back a minimum of 6m from the nearest kerb-face.
2.4.1 The owner/developer shall pay a development charge (DC) in accordance with the approved Development Charges Policy for engineering services for the City of Cape Town. The total amount payable for the proposed land use right is in accordance with the attached DC calculation is R 72355.33 This amount was valid until 30/06/2020 and the amount due will be escalated annually with the Construction Price Adjustment Formula (CPAF) using the industry indices of StatsSA. The DC shall be paid prior to the approval of any building plan relating to this application or within 30 days of the approval of this application whichever occurs first.
