Resolution details

RESOLVED that:

a. The application for deletion and amendment of restrictive title deed conditions, as set out in Annexure A, for Remainder Erf 455 Simon’s Town, BE REFUSED in terms of Section 98 (c) of the Municipal Planning By-law, 2015.

b. The application for consent in terms of Item 63(b) of the Development Management Scheme to permit a freestanding base telecommunication station on Remainder Erf 455 Simon’s Town, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015,

c. The application for departures, as set out in Annexure A, for Remainder Erf 455 Simon’s Town, BE REFUSED in terms of Section 98 (c) of the Municipal Planning By-law, 2015.

REASONS FOR DECISION:

The MPT REFUSED the application for the reasons set out below

1. The location of the cell mast will result in a significant negative visual impact on an important scenic route.
2. The mast visually intrudes above the backdrop of the mountain from most viewpoints.
