UNANIMOUSLY RESOLVED that:
a. The application for the Permanent Departure to permit the proposed dwelling house to be setback 1.5m in lieu of 3.5m from the street building line (Protea Drive), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in respect of Erf 6835, Gordon’s Bay subject to the conditions contained in Annexure A to the report.
b. The application for the Permanent Departure to permit the proposed garage to be setback 1.5m in lieu of 5.0m from the street building line (Protea Drive), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in respect of Erf 6835, Gordon’s Bay subject to the conditions contained in Annexure A to the report.
c. The application for the Permanent Departure to permit the proposed dwelling house to be setback 1.5m in lieu of 3.0m from the common building line (adjacent Erf 6668), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in respect of Erf 6835, Gordon’s Bay subject to the conditions contained in Annexure A to the report.
d. The application for the Permanent Departure to permit the proposed dwelling house to be setback 1.5m in lieu of 3.0m from the common building line (adjacent to Erf 2229), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in respect of Erf 6835, Gordon’s Bay subject to the conditions contained in Annexure A to the report.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend the 4th reason as follows:
The proposed dwelling steps naturally into the existing landscape, thereby minimising potential impact on the existing character of the area.
