Resolution details

RESOLVED UNANIMOUSLY that:

a. The application for Consolidation of Remainder Erf 33420, Erf 33421, Remainder Erf 33444, Erf 33445, Erf 33446, Erf 33447 and Remainder 33448 Cape Town at Athlone, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law 2015.

b. The application for Subdivision of the consolidated property (created by virtue of 8.1 above) into Portion 1 and a Remainder, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law 2015 subject to the conditions contained in Annexure A, attached hereto.
c. The application for the Rezoning of Portion 1 of the subdivided property, from Open Space 2 and Transport Zone 2 to Mixed Use 2 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law 2015, subject to the conditions contained in Annexure A, attached hereto

d. The application for Site Development Plan Approval, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law 2015.


Amended Conditions

That the word “Director: Planning and Building Development Management” be replaced with “Director: Development Management” in condition 2.1.1

2.2 Transport Planning Department
2.2.1 Scale of the facility must be limited to a maximum of 7177m2 of floor space.

2.2.2 The on-site parking provision must comply with the provisions of a PT1 zone and therefore a minimum of 2.5bays/100m2 GLA and 2.0bays/100m2 GLA must be provided for the office use and retail use respectively.

REASONS FOR DECISION:

The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s report
