RESOLVED UNANIMOUSLY that:
a. The application for the subdivision of Erf 38257 Cape Town into Portion 1 and a remainder BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A attached hereto.
b. The application for the subdivision of Erf 38622 Cape Town into Portion 1 and a remainder BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A attached hereto.
c. The application for the consolidation of Erf 38621 Cape Town with portion 1 created through the subdivision of Erf 38257 Cape Town and Portion 1 created through the subdivision of Erf 38622 Cape Town (referenced in 8.1 and 8.2 above respectively) BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A attached hereto.
d. The application for the rezoning of the consolidated erf created by virtue of 8.3 above, from Community Zone 1 to General Residential 2 Use Zone BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A attached hereto.
e. The application for permanent departures (as set out in Annexure A attached hereto) on the consolidated erf created by virtue of 8.3 above, BE APPROVED in terms of section 98 (b) of the City of Cape Town Municipal Planning By-law, 2015 in accordance with the plan numbers 793-2, dated 23 April 2019 drawn by Terraplan Town and Regional Planners and attached hereto as Annexure C3, subject to the conditions contained in Annexure A attached hereto.
f. The application for the Site Development Plan reference IJ 18/41(File 01-03) dated February 2017 (Revision J-23 April 2019) Drawn by I Jacobs and Associates BE APPROVED in terms of Section 98 of the City of Cape Town Municipal Planning By-law, 2015.
Amended Conditions
2.5.1 The owner must submit a detailed landscape plan to the satisfaction of the Director: Development Management prior to the submission of building plans.
2.5.3 The owner is responsible for the implementation of all landscaping prior to occupancy of the new structures and implementation of landscaping shall be to the satisfaction of the Director: Development Management and that special attention be given to the edge treatment of the development as it interfaces with the abutting development
