RESOLVED UNANIMOUSLY that:
a. The application for consolidation of Erven 67452, 67453, 67454 and 67408 Cape Town at Wynberg, into one erf, as shown on the plan attached as Annexure C2, BE REFUSED in terms of Section 98 (c) of the Municipal Planning By-law, 2015.
b. The application for subdivision of the abovementioned consolidated erf into two portions, (Portion A, 165 m²), and a Remainder, (1436 m² in extent); as shown on the subdivision plan attached as Annexure C2, BE REFUSED in terms of Section 98 (c) of the Municipal Planning By-law, 2015.
c. The application for the rezoning of Remainder Erf 178548 Cape Town at Wynberg, from General Residential (GR4) to General Residential (GR5), BE REFUSED in terms of Section 98 (c) of the Municipal Planning By-law, 2015.
d. The application for permanent departures for Erven 67452, 67453, 67454 and 67408 Cape Town at Wynberg, set out in Section 1 of Annexure A, BE REFUSED in terms of Section 98 (c) of the Municipal Planning By-law, 2015.
REASONS FOR DECISION:
The MPT REFUSED the application for the reasons set out below
1. The consolidation of the four properties will result in a building of which the massing, scale and built form will be incompatible with the context.
2. The papers served before the MPT Panel suggested that the application is not compliant with the MSDF, The Southern District Plan and the Densification policy.
3. The proposed parking ratio in this particular context is inappropriate given the fact that there is already a parking problem in this area.
