RESOLVED UNANIMOUSLY that:

a. The application for rezoning of erf 11851, Kuilsrivier, from Community Zone 1 to Subdivisional Area (General Residential Zone 1 and Open Space Zone 3), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, subject to the conditions attached as annexure A.

b. The application for subdivision of erf 11851, Kuilsrivier, into 21 General Residential 1 zoned erven and 2 Open Space 3 zoned erven (inclusive of the street names & numbering), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in accordance with the subdivision plan no. ERF11851KSR/SUB/AUGUST2018/1, dated August 2018, drawn by Atlas Town Planning, subject to the conditions attached as annexure A.

c. The application for permanent departure from the City of Cape Town Development Management Scheme in respect of erf 11851, Kuilsrivier, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in order to relax the 5m building lines along Church and Taaibos streets to 3m, in accordance with the Site Development Plan no. 1165_CDC_SDP01(sheets 01-03), dated April 2018, drawn by Johan van Zyl Architects, subject to the conditions attached as annexure A.

d. The application for consent use in respect of erf 11851, Kuilsrivier, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in order to permit a utility service (stormwater retention pond) on Portion 22, as indicated on the subdivision plan no. ERF11851KSR/SUB/AUGUST2018/1, dated August 2018, drawn by Atlas Town Planning, subject to the conditions attached as annexure A.

e. The proposed Site Development Plan in respect of erf 11851, Kuilsrivier, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in accordance with plan no. 1165_CDC_SDP01(sheets 01-03), dated April 2018, drawn by Johan van Zyl Architects, subject to the conditions attached as annexure A.

Additional Condition

Subject to the approval by the Director: Transport that construction access to the site be through a suitable access point off Church Street.
